Terms & Conditions

Scope of Services

We provide emergency mitigation, fire, smoke, water, and mold restoration, as well as reconstruction and related contracting services. By engaging our services, you authorize FAFRC to perform the agreed scope of work, including chemical treatments and drying equipment use, and understand that subcontractors may be used as needed.


Equipment & Billing

Equipment is billed for time on site, not time used, with applicable minimum rental periods as defined in your signed service documentation.


Pricing & Payment

  • Invoices are due upon receipt unless otherwise specified.
  • Unpaid balances accrue interest at 1.5% per month (18% per annum).
  • If your insurance carrier fails to remit full payment, you remain responsible for the unpaid balance.
  • Insurance proceeds received by you must be endorsed and delivered to FAFRC within five (5) days of receipt.
  • Collection costs, attorney’s fees, and court costs may be added to delinquent accounts.


Limited Scope & Mold Waivers

If you decline a full remediation protocol or authorize a limited scope cleanup, you acknowledge and accept that some mold or microbial activity may remain and release FAFRC from all related liability.


Liability & Disclaimer

  • FAFRC is not responsible for damages or defects not directly worked upon by FAFRC.
  • No consequential or punitive damages are recoverable by either party.
  • FAFRC’s total liability is limited to the total amount invoiced for the services in question.


Indemnification

You agree to indemnify and hold harmless FAFRC, its employees, subcontractors, and affiliates from any claim, damage, or expense arising from your breach or negligence.


Governing Law

This Agreement is governed by the laws of the State of Montana, and venue lies within its courts.
